In any collective agreement, certain management rights are non-negotiable, including the right to manage and operate the business, hire, promote or dismiss staff. This provision occurs when the employer has automatically deducted, on behalf of the union, dues from union members` paycheques. This ensures that a steady stream of dues is paid to the union. In a collective bargaining process, both parties are legally required to bargain in good faith. This means that they have a reciprocal obligation to actively participate in the discussions and to engage in the desire to find a basis for reaching an agreement. There are three main classifications of negotiation topics: mandatory, permissive and illegal. Wages, health and safety, management rights, working conditions and benefits fall into the compulsory category. Permitted topics are those that are not necessary, but can be addressed during the process. An example could be the requirement for drug testing for candidates or the tools necessary to make it available to the employee to perform the work, for example.B.
