There is “absolutely no doubt” that the WTO would have ruled in Mexico`s favor if Lopez Obrador had asked the trade body to settle the dispute with Trump, a process he said would have taken him about two years to make a final decision. For opponents of ECT, these arbitration tribunals are a real anti-democratic instrument. In a December 2019 open letter, 278 trade unions and associations called on members of the European Parliament, the European Commission and ECT member states to withdraw from the treaty they call the “parallel judicial system”. only at the disposal of foreign investors”. The authors continue to criticize the “highly secretive” nature of arbitration proceedings that “are imposed with conflicts of interest, as arbitrators make a lot of money from business and have an interest in maintaining the boom in ECT litigation.” This practice was also taken up at the beginning of the British occupation of India and by France in its relations with Arab tribes in North Africa. The position of a hostage was that of a prisoner of war who was to be held until the fulfillment of negotiations or contractual obligations and who, in case of treason or refusal to honor the promises made, could be punished (in the good old days) and even sentenced to death. This is not a new tactic for China. For example, there is a long story of businessmen disappearing from Hong Kong just to mysteriously get noticed on the mainland and regret on television in tears for their alleged crimes. However, it is becoming much more difficult for nations like the United States to oppose these tactics, even though the Trump administration also appears to be using hostage politics to achieve its political goals. Here, too, a combination of hypocrisy and (often sporadic) commitment to broad ideals has done the United States a good service in the past, but will be much harder to grasp in the future. The Germans also took hostages between the capitulation of a city and its final occupation as a guarantee against the outbursts of violence of the inhabitants. In an interview on the Borderlex website, ECT Secretary General Urban Rusnák describes the modernised treaty as a “complement to the Paris Agreement”.
By protecting trade and transit of renewable energy, ECT will ensure that climate commitments are met. . . .
